Virginia lawmakers did NOT exempt the State Corporation Commission from the coverage of the Freedom of Information Act. That was done a decision of the Virginia Supreme Court. In Christian v. State Corporation Commission (November 2011) the court held that the FOIA was unconstitutional as applied to the State Corporation Commission. While I think the decision is wrong, it appears that a constitutional amendment may be necessary to bring the SCC under that ambit of the law. As a member of the House of Delegates and of the committee that drafted the last comprehensive revisions to the FOIA, I can say that it is my opinion that the General Assembly did intend for the FOIA to apply to the SCC.
